Welcome to Next Equine. By accessing or using our platform, you agree to be bound by the following terms of service. Please read them carefully as they define your rights and limit our liability.
1. User Account and Conduct
- One account per person: Each user may only create one free profile. Systematic creation of multiple profiles to bypass limitations (e.g., on AI questions) is considered abuse and will result in immediate termination.
- Correct identity: Profile information must reflect your real identity. Use of pseudonyms for fraud or anonymous harassment is strictly prohibited.
- Login responsibility: You are personally responsible for keeping your login credentials confidential.
- Messages between users: When you use our messaging feature to contact a buyer or seller, we expect a respectful tone — harassment, threats, and spam are not allowed and may result in exclusion from the platform. You can report a user directly from a conversation; this allows our administrators to review that conversation as part of moderation. You can also block another user so you no longer receive messages from them — note that a block only applies on the platform and is not a guarantee against contact through other channels.
2. Content Rights (Photos & Video)
When you upload content (photos, videos, text) to Next Equine, you retain all your rights, but you grant us a worldwide, royalty-free, and transferable license to use the material.
- Marketing: We may use your horse photos and videos to promote the platform on social media (Instagram, Facebook, TikTok) and in newsletters. This also applies after the listing has expired.
- Rights holder: You warrant that you have the rights to the content you upload and that it does not infringe on third-party copyright.
3. Advertising Rules
All listings are manually reviewed by our team before publication. To ensure quality on the platform, we have the following requirements:
3.1 Photo and Video Requirements
- Minimum 3 photos or videos: Your listing must contain at least 3 photos and/or videos of the horse.
- Quality: Photos must be clear, well-lit, and in high resolution. Blurry, dark, or pixelated photos will result in rejection.
- The horse must be clearly visible: Photos must show the horse clearly from relevant angles. Photos solely from behind or at a long distance are not accepted.
- Watermarks: Photos with watermarks from other websites are not accepted. The seller's own logo or branding is permitted.
- No manipulation: AI-generated, heavily edited, or misleading photos will result in immediate rejection and potential ban.
- Match with passport: Photos must match the horse's description as stated in the passport.
3.2 Horse Passport Requirements
- Passport photo required: A clear photo of the horse's passport must be uploaded.
- Legible: The passport must be legible – all relevant information must be readable.
- ID number visible: The horse's UELN/ID number must be clearly visible.
- Data must match: Information in the passport must correspond with the listing content (breed, color, age, etc.).
3.3 Description and Price Requirements
- Detailed description: The description must be informative and give a realistic picture of the horse. Short or meaningless descriptions will be rejected.
- No offensive content: Descriptions with offensive, discriminatory, or inappropriate language are not accepted.
- Realistic price: The price must reflect the horse's real value. Unrealistically low prices (often a sign of fraud) will result in extra checks or rejection.
3.4 Additional Rules
- Manual Validation: Next Equine performs editorial checks on all listings. We reserve the right to reject or archive listings that do not meet the platform's quality requirements or safety standards.
- Technical Verification: To combat fraud, we collect and analyze technical metadata, including IP address, browser fingerprint, and location data (GPS). Any deliberate manipulation of this data (e.g., via VPN to hide real location) is considered a serious breach of terms and will result in immediate ban without refund.
- Documentation Check: We use AI and manual review to validate horse passports and identity papers. In case of suspected forgery, the material is stored for 5 years as evidence for authorities.
- No Recycling: An existing listing may not be changed to a completely new horse. One horse life = one listing.
- Identity and Phone Verification: As part of our security procedure, we may require you to verify your identity via passport/ID (Stripe Identity) and your phone number (Twilio). Failure to verify may result in limitations or exclusion from the platform.
4. Next Equine as a Platform (Intermediary)
Next Equine is solely a technological platform facilitating contact. Next Equine is not a party to the purchase agreement between users.
- We do not guarantee the actual health, condition, or legality of the advertised horses.
- Any claim arising from a transaction must be directed solely against the counterparty and not Next Equine.
- External links: The platform contains links to third-party websites (e.g., in "Equine Insights"). Next Equine is not responsible for content, privacy policy, or security on these external sites.
- Next Equine assumes no liability for losses caused by fraudulent, misleading, or inaccurate information provided by other users — regardless of whether the user is verified or not.
5. AI Disclaimer
IMPORTANT: Next Equine uses artificial intelligence (AI). AI-generated answers and analyses are indicative only.
- AI results may contain errors or inaccuracies.
- Results from EquineChat are AI-generated guidance and do not constitute professional legal advice. Always consult a lawyer if in doubt.
- Equine Insights: News summaries are AI-generated based on external sources. We do not guarantee the accuracy of the original content or the AI summary.
- We disclaim any liability for losses based on AI-generated content.
6. Subscriptions and Payment
We offer Basic (free), Premium, and Exclusive packages. Recurring subscription as a payment method is temporarily paused and not offered to new users — single-purchase Premium/Exclusive per listing is still available. If you already have an active subscription, it continues to be managed under the terms below until it expires or is cancelled. All prices include VAT unless otherwise stated.
- Cancellation: Subscriptions can be cancelled until the end of a billing period directly via your profile settings.
- Payment upon approval: When purchasing single listings (Premium/Exclusive), the amount is reserved on your card upon creation. The amount is only finally charged when your listing is manually approved by our team. If the listing is rejected, the reservation is cancelled, and you pay nothing.
- Payment errors: In case of non-payment, we reserve the right to deactivate access to paid features immediately.
7. Right of Withdrawal for Digital Content
As a starting point, you have a 14-day right of withdrawal. However, for Next Equine's services, the following rules apply in accordance with the Consumer Contracts Act's exceptions for digital content:
- Consent to delivery: Upon purchase of digital services (individual analyses, listing packages, or subscriptions), you give your express consent for the delivery of the digital content to begin immediately.
- Waiver of right of withdrawal: You acknowledge and accept hereby that your 14-day right of withdrawal lapses the moment you start using the service. Use is understood as, for example, performing an AI scan, using digital guidance tools, or accessing information reserved for paying users.
- Subscriptions: For users with an existing subscription: as access to our digital infrastructure is delivered immediately upon activation, you cannot claim a refund for a commenced subscription period once you have started using the service. However, you can cancel your subscription at any time until the end of the current paid period.
- If you have not used the service: If you have purchased a service by mistake, and you have not yet not started using it, you can withdraw within 14 days by contacting us at .
8. General Limitation of Liability
Next Equine can under no circumstances be held liable for indirect loss, operating loss, or loss of data. Our total liability can never exceed the amount you have paid to us in the last 12 months.
9. Deletion of Account
You can request deletion of your account at any time via settings. To protect the platform against fraud and enable potential investigation of recent activities, the following applies:
- 30-day quarantine: Your profile is deactivated immediately, but your data is only permanently deleted after 30 days.
- Legal retention: If an account is under investigation for abuse or fraud, evidence may be stored for up to 5 years, regardless of deletion request.
- Bookkeeping: Information related to financial transactions and purchased services is stored for 5 years in accordance with the Bookkeeping Act.
11. Private Sale / Buyer Matching
As part of our service, Next Equine offers a matching service ("Private Sale"), where we attempt to match sellers with potential buyers from our network, without the horse being publicly advertised. The following terms apply specifically to this service.
11.1 The Intermediary Role
- Contact facilitation only: Next Equine acts solely as a facilitator of contact. We pass on the seller's information to relevant buyers in our network at our own discretion.
- Not party to the transaction: Next Equine is not at any time a party to any resulting purchase agreement. Any transaction is concluded directly and solely between seller and buyer.
- No guarantee: We endeavour to find suitable buyers, but do not guarantee that an enquiry will lead to contact, a viewing or a sale.
11.2 Seller's Responsibilities
- Accurate information: The seller is responsible for ensuring that all information about the horse (age, level, health status, ownership, etc.) is accurate and complete.
- Lawful sale: The seller confirms having full right to sell the horse, and that the horse is not subject to any lien, retention of title or third-party rights.
- Veterinary examination: It is the sole responsibility of the seller and buyer to arrange and fund any pre-purchase veterinary examination before a transaction is concluded. Next Equine always recommends an approved pre-purchase examination and may offer guidance on the process — such guidance is purely advisory and does not constitute professional veterinary advice.
11.3 Advisory Guidance, Contracts and Legal Assistance
- Advisory recommendations: Next Equine may, in connection with the facilitation, provide non-binding recommendations on matters such as the transaction process, contract points or horse trading in general. Such recommendations are based on experience and good practice, but do not constitute professional legal, veterinary or financial advice. Next Equine accepts no liability for decisions made on the basis thereof.
- Contract: Next Equine does not prepare, provide or approve purchase contracts. The parties are themselves responsible for entering into a written agreement governing purchase price, liability for defects, delivery date and transfer of risk.
- Legal advice: Next Equine does not provide professional legal advice. We recommend that the parties seek independent legal counsel before signing any agreements.
11.4 Service Terms
- Free to use: Registering and using the Private Sale service is always free. Next Equine charges no upfront fee for facilitation.
- Facilitation fee on sale: Upon a completed sale, Next Equine charges a facilitation fee of 5% of the agreed sale price, rounded up to the nearest whole 1,000 DKK (or equivalent in EUR). The fee falls due upon conclusion of the final agreement between seller and buyer.
- No fee without a sale: If the facilitation does not result in a completed sale, the seller pays nothing.
- No charges without consent: The seller will never be charged any fee without prior written acceptance of the specific terms.
11.5 Disclaimer
- Next Equine disclaims all liability for the horse's health, condition, performance, legality or value.
- We are not liable for any loss, damage or dispute arising from a transaction facilitated via the Private Sale service — including but not limited to defects in the horse, breach of contract, non-payment or disagreements between the parties.
- Complaints and claims must be directed at the counterparty in the transaction and not at Next Equine.
11.6 Processing of Personal Data
- Purpose: Contact details collected via the Private Sale form are used solely to facilitate contact with relevant buyers in our network and are processed in accordance with our Privacy Policy.
- No resale: We do not sell your personal data to third parties and share it only with potential buyers as part of the matching process.
11.7 Buyer Registration and Expectations
- Non-binding registration: Submitting the search form on our Private Sale page does not constitute a purchase offer, a reservation, or a binding agreement. It is solely an expression of interest in being contacted should a horse matching your criteria become available.
- No guarantee of contact: Next Equine does not guarantee that you as a buyer will be contacted. A registration depends on a horse in our network matching the stated criteria, and on the seller wishing to be put in contact with the buyer in question.
- No exclusivity: Multiple buyers may have registered with similar criteria. Next Equine may contact several interested parties in relation to the same horse. A registration does not confer any right of first refusal, exclusivity, or obligation on the part of the seller.
- Buyer's own responsibility: Regardless of any contact facilitated by Next Equine, it is always the buyer's own responsibility to independently assess the horse — including obtaining veterinary advice, reviewing health documentation, and verifying the horse's legal status (ownership, any encumbrances, etc.) before entering into an agreement.
- No obligation to transact: Neither the buyer nor the seller is under any obligation to complete a purchase as a result of a facilitated introduction. Any further dialogue and any agreement reached is solely the responsibility of the parties involved and takes place without Next Equine's participation.
- Withdrawal: A buyer may at any time request deletion of their registered search criteria by contacting Next Equine. The information will be deleted within 30 days of receiving the request.
10. Governing Law and Jurisdiction
Any dispute between the user and Next Equine shall be settled under Danish law at Copenhagen City Court.
